In a resolution recently published in Bolivia's Official Gazette, the Bolivian Constitutional court ruled that the requirement to pay assessed tax prior to beginning judicial appeal procedures is unconstitutional. Taxpayers in Bolivia can dispute tax assessments through an administrative dispute resolution system or by appealing through the judicial system.
In its ruling, the Court held that the requirement is unconstitutional because it infringes on several constitutional rights, including the right of due process, the right of due defense and others.
