Chad Tax Changes for 2018

A number of tax changes were introduced in Chad for 2018 through the 2018 Finance Law, which was adopted by the Chad parliament on 28 December 2017. The main changes include:

  • The introduction of new rules to limit the deduction of interest expense paid by a branch to its foreign parent by including interest expense and related financial charges within the scope of the 10% of fiscal profit deduction limit that applies for general administrative and foreign technical assistance costs;
  • The elimination of the reduced withholding tax of 12.5% on service payments by companies in the oil and gas sector to non-resident providers (standard 25% rate now applies);
  • The reintroduction of a flat 20% withholding tax on rental income paid to non-resident individuals or entities;
  • The introduction of general transfer pricing documentation requirements for taxpayers that are controlled by, have control of, or are affiliated with non-resident companies, including the disallowance of expenses in relation to transactions for which documentation is not provided upon request of the tax authority; and
  • The introduction of a set deadline for the submission of a corrected tax return, which is two months following initial submission.

Changes introduced by the 2018 Finance Law are generally effective 1 January 2018.
