The Netherlands has recently published notices in the Official Gazette on the termination of several savings tax agreements in respect of Aruba and Curaçao effective 1 January 2019. For Curaçao, only the Croatian agreement was solely in respect of Curaçao, while the others are in respect of the former Netherlands Antilles and continue to apply for relations between Sint Maarten and the respective countries.
The agreements terminated for Aruba include those with: Austria, Belgium, Bulgaria, Cyprus, Denmark, Finland, Germany, Greece, Ireland, Lithuania, Malta, Spain, and Sweden.
The agreements terminated for Curaçao include those with: Croatia, Cyprus, the Czech Republic, Denmark, Finland, Germany, Greece, Ireland, Latvia, Malta, Poland, Portugal, Romania, Slovenia, the Slovak Republic, and Spain.
The reason for the termination is the repeal of the EU Savings Directive, which was replaced by the amended provisions of the EU Administrative Assistance Directive.
