The Ukraine government has published Cabinet Resolution No. 108 of 31 January 2018, which amends the appendix to Cabinet Resolution No.1045 of 27 December 2017 on the list of tax havens (previous coverage). Transactions with residents of listed jurisdictions are impacted in two main ways: 1) the transactions are deemed controlled whether related or not; and 2) the deduction of expenses in relation to the transactions may be limited to 70%, unless it can be shown that a transaction is at arm's length. Resolution No. 108 provides for the exclusion of Estonia, Georgia, Hungary, Latvia, and Malta from the list, although for the period 1 January 2018 to 7 March 2018, the jurisdictions are still considered listed.
